General Terms and Conditions (GTC)

§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all orders and purchases made through the online store of Sport-B Bütschwil GmbH .
By placing an order, the customer confirms that they have read and understood these Terms and Conditions.
Any deviating agreements require the express consent of Sport-B Bütschwil GmbH.
Simply using or viewing the online store does not constitute a contractual relationship.
§ 2 Offer and Conclusion of Contract
The presentation of products and services in the online store does not constitute a legally binding offer. Product images are for illustrative purposes only. Minor variations, particularly with regard to color and appearance, are possible due to differences in monitor settings or production-related variations.
By submitting the order, the customer makes a binding offer to purchase the products contained in the shopping cart.
Upon receipt of the order, the customer will receive an electronic order confirmation. This confirmation first acknowledges receipt of the order.
The sales contract is concluded upon Sport-B Bütschwil GmbH’s express confirmation of the order, shipment of the goods, or notification that the goods are ready for pickup.
Sport-B Bütschwil GmbH reserves the right to reject orders, particularly due to unavailability, obviously incorrect prices, or incorrect product information.
§ 3 Prices
All prices listed in the online store are in Swiss francs (CHF) and include the legally required value-added tax, unless otherwise expressly stated.
The price displayed in the online store at the time of the order is the one that applies.
Shipping costs and any additional charges will be shown separately before the order is completed.
We reserve the right to correct any obvious errors in pricing, spelling, or presentation.
§ 4 Availability and Delivery Times
Items in stock will be shipped or made available for pickup as soon as possible after the order is received and processed.
Items that are not in stock will be ordered from the respective supplier whenever possible. In this case, the delivery time depends on availability from the supplier.
Delivery time estimates are generally approximate, unless a binding delivery date has been expressly agreed upon.
If an ordered item cannot be delivered, or cannot be delivered within a reasonable time, Sport-B Bütschwil GmbH will notify the customer as soon as possible.
Payments already made for items that are definitely unavailable will be refunded.
Delays in delivery caused by suppliers, force majeure, or other circumstances beyond the control of Sport-B Bütschwil GmbH do not give rise to claims for damages to the extent permitted by law.
§ 5 Shipping and Pickup
Delivery will be made to the shipping address provided by the customer when placing the order.
The applicable shipping costs will be displayed during the ordering process before the order is finalized.
For orders totaling CHF 200.00 , standard shipping within Switzerland is free, unless otherwise specified in the online store.
If offered in the online store, orders can also be picked up directly at the Sport-B Bütschwil GmbH store in Bütschwil.
§ 6 Terms of Payment
The payment options displayed in the online store during the ordering process are available.
For purchases on account, the invoice amount must be paid within the payment period specified on the invoice.
Sport-B Bütschwil GmbH reserves the right not to offer certain payment methods for specific orders or to certain customers.
In the event of late payment, reasonable late fees and interest on late payments as permitted by law may be charged.
§ 7 Voluntary Right of Return and Exchange
Sport-B Bütschwil GmbH grants individual customers a voluntary right to return items purchased in the online store within 14 days from receipt of the merchandise.
The merchandise must be returned within 14 days of receipt or returned to our store in Bütschwil. You do not need to notify us in advance of the return.
The items must be in perfect, complete, and saleable condition . Inspecting or trying on the merchandise, as would be possible in a retail store, is permitted. In particular, shoes may only be tried on indoors.
If available, items must be returned with their original packaging, labels, accessories, and all included components.
The customer is responsible for the costs and shipping risk associated with a voluntary return. There are no return shipping costs for in-person returns at our store in Bütschwil.
Once the returned merchandise has been received and inspected, the purchase price paid for the returned items will be refunded via the original payment method.
The cost of the original shipment, as well as any costs for additional shipping or services, will not be refunded in the event of a voluntary return.
Exclusion from the Voluntary Return Policy
The following items, in particular, are excluded from the voluntary return policy:
- items that are custom-made, personalized, or procured according to customer specifications;
- Items that have already been used, worn, washed, soiled, or damaged, provided that such use goes beyond a normal inspection or try-on;
- Items from which labels, seals, or essential components have been removed;
- Goods that, for hygienic reasons, cannot be resold after they have been opened or used;
The rights regarding defective or incorrectly delivered goods remain unaffected by the voluntary right of return and exchange.
§ 8 Defects and Warranty
Customers are asked to inspect the delivered goods upon receipt for obvious defects, incorrect deliveries, and damage incurred during shipping, and to notify Sport-B Bütschwil GmbH of any defects found as soon as possible.
In the case of valid defects, the statutory warranty provisions apply, unless a legally binding agreement to the contrary has been made.
Sport-B Bütschwil GmbH is entitled, at its discretion, to remedy a defect, in particular by repair, replacement, a price reduction, or another reasonable solution , provided this is reasonable for the customer.
The warranty specifically excludes damage and defects resulting from
- normal wear and tear;
- improper use or handling;
- Failure to follow care, maintenance, or usage instructions;
- excessive or improper use;
- external influences;
- Modifications or repairs made by the customer or by unauthorized third parties
can be attributed to.
Any manufacturer's warranties apply independently of the warranty provided by Sport-B Bütschwil GmbH and are governed by the manufacturer's respective warranty terms and conditions.
§ 9 Incorrect Deliveries and Damage During Transport
In the event of an incorrect delivery or a valid complaint due to defective merchandise, Sport-B Bütschwil GmbH will cover the necessary return shipping costs.
Any visible damage caused during shipping should, if possible, be reported immediately to the shipping carrier and also reported to Sport-B Bütschwil GmbH.
Failure to report damage incurred during transport immediately does not automatically result in the loss of legal claims.
§ 10 Liability
Sport-B Bütschwil GmbH is liable, within the limits set by law, for damages caused by willful misconduct or gross negligence.
To the extent permitted by law, any further liability—in particular for indirect damages, consequential damages, or lost profits—is excluded.
We reserve the right to apply mandatory statutory liability provisions.
§ 11 Data Protection
Personal data is processed in accordance with the privacy policy of Sport-B Bütschwil GmbH and applicable Swiss data protection regulations.
The current privacy policy is available in the online store.
§ 12 Changes to the Terms and Conditions
Sport-B Bütschwil GmbH reserves the right to amend these Terms and Conditions at any time.
The version of the Terms and Conditions in effect at the time the order is placed applies to that order.
§ 13 Governing Law and Jurisdiction
The following applies Swiss law , excluding conflict-of-laws provisions, unless otherwise required by mandatory statutory provisions.
For disputes with consumers, the statutory mandatory jurisdictions.
For business customers, companies, and legal entities, to the extent permitted by law, Bütschwil-Ganterschwil, Switzerlandis agreed upon as the place of jurisdiction.
